Trademark Guaranteed Registration

Published: 2020-02-12

What is Guaranteed Registration?

It refers to a trademark application filed through Guaranteed Registration. If the Trademark Office rejects the entire application for any reason, our company will refund all fees paid at the time of filing.

Note: A 2% withdrawal fee will be deducted for withdrawals.

Why is trademark registration unsuccessful?

A. Blind search period risk

It usually takes about one month from submitting a trademark application to it being entered into the Trademark Office system. As a result, identical or similar trademarks filed within the previous month cannot be found, posing a certain risk to trademark registration, namely the blind search period risk.

B. Subjective judgment of Trademark Office examiners

Word marks, device marks, and combined marks may all have multiple meanings. The Trademark Office has multiple examiners, and examiners differ in qualifications and experience, so they may have different perceptions of the same trademark.

C. Similar trademarks

It refers to trademarks whose pronunciation, appearance, or meaning is highly similar to a previously filed trademark. Highly similar trademarks exist.

Note: A 2% withdrawal fee will be deducted for withdrawals.

Precautions for Guaranteed Registration

If a trademark meets the review conditions for Guaranteed Registration, an application may be submitted; if not, it may be converted to Express Registration.

If the trademark status is preliminary approval and publication, the guarantee is deemed successful and no refund will be issued.

If the trademark status is partial refusal, the guarantee is deemed successful and no refund will be issued.
